Testing for illicit drug use
In our work we see more and more drug abuse in the workplace. In 2014 we were specially trained for this area, because we finished a special training, which only two detectives from Slovenia attended. Also one detective in our collective graduated on this topic. In our company we place great importance on this area.
Practice related to detection of work under the influence of drugs, which has established itself in European countries and elsewhere in the world, is slowly transferring itself into the Slovenian space.
In 2011 the legislator added a significant novelty in the Law on health and safety at work , i.e. prohibition of work under the influence of alcohol, drugs and other substances. The provision of Article 51 dictates that an employee may not work or be at work under the influence of drugs, and the detectives may, on the basis of the Private Investigation Law , acquire information about work under the influence of illicit drugs.
No legal provision regulates the procedure and method of detection of work under the influence of drugs. Because of that, the employer must establish an internal act.
